Enduring Powers of Attorney (financial and medical treatment) and Enduring Power of Guardianship
Harwood Andrews Lawyers’ Wills and Estates team has substantial experience in advising clients about executing enduring powers of attorney to authorise a trusted person to act for them when they are overseas, hospitalised or no longer capable of looking after their own affairs. This includes appointing a person to assist in looking after the donor’s assets and finances or to make medical decisions on the donor’s behalf.
We outline to clients the nature and consequences of the different enduring powers of attorney that can be executed and the circumstances in which a person can act on your behalf, as well as how the arrangement can be annulled.
We administer the formal legal requirements that are associated with enacting an enduring power of attorney, such as the preparation of the requisite documentation and their safekeeping.
We also advise clients in relation to the role of the Guardianship and Administrative List of the Victorian Council of Appeals and Tribunals, which can hear challenges for decisions made by the attorney.
