We have assisted a large number of clients and their families to negotiate, formalise and implement financial settlements following relationship breakdowns. We do so by applying our full understanding of family law, adopting a supportive approach and guiding clients through the stages involved in achieving a resolution.
A number of assets are subject to division, including real estate, motor vehicles, shares, superannuation, savings and life insurance policies. Debts are typically the home mortgage, personal loans and credit cards.
However the relevant assets and liabilities can extend well beyond those listed above.
We have specialist expertise in negotiating, documenting and executing complex financial settlements involving companies, trusts, businesses, taxation liabilities and self managed superannuation funds.
We are uniquely placed to address the issues confronting clients who experience relationship breakdowns involving substantial business and personal assets and income levels. Our business law department provides valuable expertise in such circumstances.
Where parties cannot agree on a fair and reasonable settlement and negotiations have been unsuccessful, we assist clients in Court applications for property division. Once proceedings have been commenced parties are required to participate in mediation or conciliation, providing a further opportunity for settlement without a Court hearing. We represent clients on these occasions and take a constructive approach.
If mediation or conciliation does not produce a settlement and Court proceedings are necessary we use our considerable experience in family law to carefully analyse each client’s unique situation and work towards achieving a fair and equitable distribution of their assets and liabilities.
